Abstract: 

What light does transformative environmental constitutionalism shine on the judiciary’s approach to water law cases? In this seminar Tracy-Lynn Field explores the scope of political and judicial progressiveness inherent in the idea of transformative constitutionalism and transformative environmental constitutionalism. She explores the tensions in transformative environmental constitutionalism and what it might mean to adopt a justice-oriented, socio-ecological systems perspective of issues in the water sector. Finally, she applies these insights to evaluate the Constitutional Court decisions in the Mazibuko, Sembcorp Siza and Lotter cases.
 

Bio: 

Professor Tracy-Lynn Field

Tracy-Lynn Field has twenty years’ research and teaching experience in the fields of natural resource and environmental law, with a current interest in water and energy law and justice. She has published in national and international peer-reviewed academic journals, as well as the popular media and has successfully supervised more than 30 LLM and PhD students. Her current and past research and consulting engagements have involved work for the South African Human Rights Commission, the FILE Foundation, and the Water Research Commission, amongst others. She currently holds the Claude Leon Chair in Earth Justice and Stewardship at Wits University.
