
How can legal and governance responses to urban and global crises be transformed to foster urban resilience?

The global Covid-19 pandemic highlighted the vulnerability and fragility of urban systems like never before. It also underscored the urgent need to adapt regulatory and institutional frameworks to future crises. This paper examines "adaptive law and governance" as a strategy for city authorities to enhance resilience. Adaptive law and governance refer to flexible and resilient legal and governance frameworks designed to adjust and evolve in response to changing conditions and emerging challenges. The paper compares the responses of Amsterdam and Rotterdam in the Netherlands with Johannesburg and Cape Town in South Africa, revealing how different constitutional and socio-economic contexts influence adaptive urban governance. In the Netherlands, the decentralized system allowed for flexible and localized responses, although initial ambiguity in measures led to confusion. Amsterdam and Rotterdam implemented stricter local measures, demonstrating the advantages of decentralized authority in crisis management. Conversely, South Africa's centralized approach under the Disaster Management Act resulted in a top-down response dominated by national directives. While Cape Town's existing resilience planning aided its response, the national lockdown's harsh enforcement and economic impacts strained local capacities. Johannesburg aligned closely with national regulations, emphasizing compliance and coordination. The paper concludes that cities operating within flexible, decentralized legal systems are better positioned to implement responsive and context-specific crisis measures. Legal frameworks should support flexibility, transparency, accountability, and the distribution of power to local authorities to enable agile and effective responses to urban crises. This approach can transform law and governance responses towards fostering urban resilience in an era of increasing uncertainties, also in the context of climate change.Link to Article
