This book provides a broad overview of the Islamic law of succession and its application in South Africa. The book provides and explains the textual evidence governing Islamic law of succession in South Africa. The interpretation of the Sharee'ah is discussed in the context of Islamic succession law. The various classes of claims against the ‘deceased estate’ are examined, highlighting some instances where differing opinions are present. The three main classes of claims discussed in the book are liability claims, wasiyyah claims, and meeraath claims. The book concludes with an examination the status of Muslims who die without wills in South Africa. The book is designed to assist legal practitioners with drafting a basic Islamic will, as well as assist with understanding the process that needs to be followed when administering an estate based on an Islamic will.
