The article examines the prison reforms in Mozambique since 2013, highlighting the role of judicial decisions in the prison system. Despite legislative changes, such as the introduction of alternatives to imprisonment, challenges such as overcrowding and inadequate infrastructure persist. Solutions are proposed, including the use of legal instruments and the decolonisation of the general punitive approach to criminal justice, recognising and respecting local knowledge. These measures aim to promote a more inclusive and effective justice system in Mozambique. The critical analysis of the need to decolonise criminal justice in Mozambique highlights the ongoing application of punitive approaches despite reforms. The article suggests a new justice paradigm that considers local culture and promotes alternatives to imprisonment, offering a broad view of the structural and social issues that need to be addressed for true and effective reform.
